Terms & Conditions

These Terms & Conditions (“Terms”) govern your engagement with Brightness Cleaning (ABN 19 605 088 060) of 19 Hotham Road, Minto NSW 2566 (“we”, “us”, “our”). By accepting a written quote or by allowing us to perform services, you (“the Client”) agree to these Terms.

1. Services

We provide cleaning, security, gardening and building maintenance services as scoped in our written quote. Each quote forms a service agreement once accepted in writing (including by email). Any additional work outside the quoted scope will be quoted separately or charged on a time-and-materials basis with prior approval.

2. Quotes & pricing

• Quotes are valid for 30 days from the date issued unless otherwise noted.
• All prices are in Australian Dollars and exclusive of GST unless explicitly marked GST-inclusive.
• Variations in scope, frequency, access, or site condition may result in revised pricing — communicated in advance.

3. Bookings & scheduling

• Ongoing service schedules are confirmed in writing and reviewed annually.
• For one-off jobs, the Client must provide accurate access details and any safety notes prior to attendance.
• If our team cannot access the site at the agreed time due to factors outside our control, a callout fee may apply.

4. Cancellations & changes

• One-off bookings: 24 hours’ notice required to cancel or reschedule. Cancellations inside 24 hours may incur a 50% charge.
• Ongoing contracts: 30 days’ written notice to terminate. Pause / skip a visit with 24 hours’ notice at no charge.

5. Payment terms

• Ongoing contracts: Invoiced monthly, payable within 14 days of invoice date.
• One-off jobs: Payable on completion via card, EFT or invoice (terms agreed at quote stage).
• Overdue accounts may incur interest at 10% per annum and may result in suspension of services until paid.
• We use Xero / Stripe / EFT for payment. Card surcharges (if any) will be disclosed at point of payment.

6. Access & security

The Client is responsible for providing safe and lawful access to the site. Where keys, codes or access cards are entrusted to us, we will store them securely and use them only for the agreed purpose. The Client must inform us of any unusual hazards (asbestos, biohazards, secured items, surveillance equipment) before we attend.

7. Insurance

We hold $20 million Public Liability insurance and Workers Compensation cover. Certificates of currency are available on request. We are not liable for items not disclosed before service or for damage caused by pre-existing defects.

8. Warranties & re-clean policy

• We warrant that our work will be performed with due care and skill, consistent with industry standards.
• For end-of-lease cleans, if the agent flags items on the standard checklist within 72 hours of completion, we will re-clean those items at no charge.
• For ongoing services, issues must be raised within 24 hours of visit to be eligible for free remediation.

9. Limitation of liability

To the extent permitted by law, our total liability for any claim arising out of these Terms or our services is limited, at our option, to: (a) re-performance of the relevant services; or (b) refund of the price paid for the relevant services. We exclude liability for indirect or consequential loss, loss of profits, business interruption or loss of data.

Nothing in these Terms excludes or limits any consumer guarantees under the Australian Consumer Law.

10. Health & safety

Our team will comply with reasonable site-specific WHS requirements. The Client agrees to provide a safe working environment and notify us of any hazards in advance. We may pause or cease work if the site presents an unmitigated safety risk.

11. Confidentiality

Each party will keep confidential any non-public information disclosed by the other during the engagement. We will sign site-specific NDAs on request.

12. Privacy

How we collect, use and protect personal information is set out in our Privacy Policy.

13. Disputes

If a dispute arises, the parties will first attempt to resolve it in good faith through direct discussion. Where this is unsuccessful, disputes will be referred to mediation before any legal proceedings, except where urgent injunctive relief is required.

14. Governing law

These Terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of NSW.

15. Changes to these Terms

We may update these Terms from time to time. The most recent version is published on this page and applies to all engagements after the “last updated” date. Material changes affecting active contracts will be communicated directly.
