The agreement between you and Brightness Cleaning when you book or use our services.
These Terms & Conditions (“Terms”) govern your engagement with Brightness Cleaning (ABN 19 605 088 060) of 19 Hotham Road, Minto NSW 2566 (“we”, “us”, “our”). By accepting a written quote or by allowing us to perform services, you (“the Client”) agree to these Terms.
We provide cleaning, security, gardening and building maintenance services as scoped in our written quote. Each quote forms a service agreement once accepted in writing (including by email). Any additional work outside the quoted scope will be quoted separately or charged on a time-and-materials basis with prior approval.
The Client is responsible for providing safe and lawful access to the site. Where keys, codes or access cards are entrusted to us, we will store them securely and use them only for the agreed purpose. The Client must inform us of any unusual hazards (asbestos, biohazards, secured items, surveillance equipment) before we attend.
We hold $20 million Public Liability insurance and Workers Compensation cover. Certificates of currency are available on request. We are not liable for items not disclosed before service or for damage caused by pre-existing defects.
To the extent permitted by law, our total liability for any claim arising out of these Terms or our services is limited, at our option, to: (a) re-performance of the relevant services; or (b) refund of the price paid for the relevant services. We exclude liability for indirect or consequential loss, loss of profits, business interruption or loss of data.
Nothing in these Terms excludes or limits any consumer guarantees under the Australian Consumer Law.
Our team will comply with reasonable site-specific WHS requirements. The Client agrees to provide a safe working environment and notify us of any hazards in advance. We may pause or cease work if the site presents an unmitigated safety risk.
Each party will keep confidential any non-public information disclosed by the other during the engagement. We will sign site-specific NDAs on request.

If a dispute arises, the parties will first attempt to resolve it in good faith through direct discussion. Where this is unsuccessful, disputes will be referred to mediation before any legal proceedings, except where urgent injunctive relief is required.
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of NSW.
We may update these Terms from time to time. The most recent version is published on this page and applies to all engagements after the “last updated” date. Material changes affecting active contracts will be communicated directly.
